shipping container sales and delivery services (“Services”). By using our Services, you (“Buyer”, “you”, or “your”) agree to be bound by these Terms.
2. Container Acceptance and Limitations
2.1
Unit Condition: You acknowledge that you are buying a container unit of a specified grade (e.g., New/One-Trip, Cargo-Worthy, Wind & Water Tight). We reserve the right to refuse sale of units deemed unsuitable or structurally compromised. 2.2
Inspection and Acceptance: The Buyer is responsible for inspecting the container unit upon delivery.
Signing the delivery receipt constitutes acceptance of the unit’s condition as delivered. 2.3
Accurate Information: You warrant that all information provided regarding the delivery site, including access, required equipment, and dimensions, is
accurate and complete. Discrepancies may result in delivery delays and additional charges.
3. Buyer’s Responsibilities
3.1
Site Preparation: You are responsible for ensuring the delivery site is accessible, level, and prepared for the safe placement of the container unit. 3.2
Local Regulations: You are responsible for obtaining all necessary local permits, licenses, or documentation required for placing a shipping container on your property. 3.3
Fees and Taxes: You are responsible for all sales taxes, fees, and other charges associated with the purchase payable to the relevant authorities.
4. Container Equip Liability
4.1
Warranty: Our liability is limited to the terms of the specific warranty provided for the purchased container grade (if any). Used units are typically sold
“as-is.” 4.2
Limitation of Liability: We are not liable for any indirect, consequential, or incidental damages arising from the delivery, placement, or subsequent use of the container. Our liability for non-conforming or damaged units is limited solely to the repair, replacement, or refund of the purchase price, as per Section 3 in our Returns Policy.
5. Delays
5.1
Commercially Reasonable Efforts: We will use commercially reasonable efforts to deliver your container on the scheduled date. However, we are not liable for delays caused by factors beyond our control, including:
- Weather conditions impacting transport
- Mechanical failures of transport equipment
- Road closures or logistical issues
- Acts of God (e.g., natural disasters)
- Government restrictions 5.2 Communication: We will keep you informed of any delays impacting your delivery to the best of our ability.
6. Payment
6.1
Full Payment Required: You are responsible for
full payment of the container price, delivery charges, and all associated costs before the container is released for delivery. 6.2
Payment Methods: We accept various payment methods as listed on our website. Late payments may be subject to interest charges and/or order cancellation.
7. Indemnification
You agree to indemnify, defend, and hold
Container Equip harmless from and against any and all claims, liabilities, losses, damages, costs, and expenses (including attorney fees) arising out of or related to:
- Your breach of these Terms.
- Any injury or damage occurring on the delivery site after the unit has been safely placed.
- Any failure to secure necessary local permits or violations of local property law.
8. Termination
Container Equip may terminate these Terms and cancel an order at any time, with or without cause, and may refuse to provide Services to you in the future.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [State/Country where

10. Dispute Resolution
